What is the state minimum that the guy had to have to be legal $ wise? Since the guy hit you first, would his insurance pay for your vehicle first? Never dealt with an underinsured situation, but I had a guy hit me that was uninsured and my policy did not go up. Odd that yours is going up since nothing was your fault. Did you get a ticket for anything?

You can sue your own insurance company for "pain and suffering" related to any injuries. It's best if you go to a doctor immediately but you can still squeeze them for a little if you have proof of injury. They can't drop you if you continue to make your insurance payments.

Check out this link. This is what happened to me after some idiot came around a corner too fast.
The Wreck
The guy in the white truck came across the center line, caught the side of my Chevy, then spun sideways and got t-boned by the car that was following me. He ended up with a broken back. The lady and 2 kids in the car were ok. I jarred my back pretty good and my little brother slammed his face on the passenger side window and had a swollen up cheek for a couple of days.

Now the guy's insurance company won't pay for anything since he didn't have enough coverage and my insurance rate is going up. Go figure....

We were considering suing the guy but its not going to do much. He is out of work for a while and will end up having to sell most of his stuff that he owns just to get by now. So there would be nothing to sue for. I believe we are going to try and get him or his insurance company to pay for the deductable that our insurance company is making us pay for. The main thing that ticks me off is this is his second accident due to going around a corner too fast. He flipped a tractor-trailer over going around a corner too fast. I don't think he is being charged with anything other than crossing the centerline.

I've got my new GMC now but that just doesn't have the same value as what my Chevy had. My dad bought that new and took amazing care of it and then when I got my license I got it. We had been talking the weekend before that accident that we would never sell it. Oh well, thats life.

Our insurance company isn't going to do anything. I believe the guy's insurance company has to still pay for our medical bills and the deductable but thats it. What really pisses me off now is that our insurance is going to go up $350 per 6 months for the next 3 years because we filled a claim. Insurance companies really are crooks. You pay an arm and a leg to start out with, and then when you file a claim they jack your cost up again.

Last week I saw two cases of what happens when people are going to fast. There was a guy on a motorcycle about a mile from my house that hit a telephone pole and broke the pole on impact. He died at the scene.

On the way to go mow some lawns we saw a lady in a van coming up to a stop sign pretty fast and my dad was just like "Holy sh!t look at that lady flying. We unloaded our mowers and about 5 minutes later saw a few rescue vehicles go by and then the big heavy rescue truck go by. About 15 minutes later the medivac helicopter landed in a field near where me and my dad were mowing. Turns out it was the same lady in the van. We went past the accident scene on the way back home and the van was wrapped around a tree. The lady never even made the turn, just kept going straight. I have no doubt she would be dead, but somehow the van spun around backwards and sideways before impact and the tree hit the passanger side of the vehicle. Not sure how she is doing, but from the looks of the van she will be very lucky if she survived.

3 cases of local accidents in the past 3 weeks that could have been prevented if people would have just slown down.......

I was not at fault for any of the accident. I believe the state minimum is $25,000 and that is what the guy had. In that accident I ended up sitting on top of 3 mailboxes and some other lawn ornamants in somebody's front lawn and my mom talked to those people last night and the guy's insurance company (Nationwide) is giving them a hard time too about paying for their damage. Once our insurance company took over our claim we had our check in 3 days. The lady in the car has still not seen a check yet and they are giving her a hard time about the value of her car. She has Nationwide also.

Yeah, they definately ended up screwing us over. They offered me and my little brother a check for "pain and suffering." The company told us that $200 would be about the max they would pay. We were not expecting any money for this so we agreed to it (Getting a new pair of riding boots with that). My mom called the lady and told her about it. For them the insurance company offered $500 but somehow they ended up getting $800, so they pretty much screwed us over. I'm not sure if its because we arent Nationwide customers or if the lady did a lot of complaining of what the deal was.

Well here comes Series II of "Why you watch out for idiots". This afternoon my girlfriend got rear-ended. She was following the School Resource Officer who stopped to catch some little kid who was running away from his mom. She stopped behind him and then a car came up behind her and didn't lock up his brakes until about 30ft behind her. The front end of his car went underneath the backend of her Mustang. The front end of the dudes car is messed up. Her car doesn't look really back. The bumper is pushed under a couple of inches but the Ford place said that they think the frame might be bent which makes sense since the mat in her trunk won't lay down flat anymore.

I have a feeling this will be a bunch of fun since the dude had Nationwide for his insurance. At least now that we are done dealing with them they know what to watch out for. I'll post pics later.

Yeah, I'm very glad I was in that truck instead of something little when I got hit. My girlfriend got the estimate back for her Mustang and luckily it is nothing really major. They will have to replace the rear bumper and replace the the floor of the trunk where the spare tire was. Luckily the backend of her car sits up kind of high and the front end of the guys car was kind of low, so his car went under her's instead of smashing directly into the back of it. The Ford guys said that the spare tire that was recessed in the trunk absorbed most of the impact. So luckily the car will be fine.

On the not so good side, there was a Jr. that got in a serious wreck on his way home from school Monday afternoon. His front tire went off the road and he went into a ditch and flipped and his arm went out threw the open window and was stuck underneath the car. He was airlifted. So far two surgeries have been performed on his arm, but they doubt they will be able to save it. Another kid was sideswipped the same way I was Saturday night but the police figure the other guy was doing around 115mph at the time of impact. That guy is also in critical condition and was airlifted. The kid was ok other than a concussion and very bruised ribs. His poor truck (very similar to mine) was totatalled.

Geez, this REALLY ISN'T A GOOD WEEK. Last night a Jr. from my school was killed in a wreck. He was in a Geo Tracker with two other people stopped on an interstate offramp and was rearended. The Tracker exploded on impact. He and the driver couldn't escape. The person in the front passenger seat was able to crawl out threw a window but was severally burned.

Just got through with a suit against nationwide. After paying for the wife's doctor bills and time missed from work, it came to 175 dollars. After attorney costs, we got a check for just under 4000. Still having a go round about the truck being fixed.

Get an attorney. Sure they're going to take some of the money, but at least you'll make sure the insurance company pays all they're supposed to and not leave you with any unpaid bills.

Heck I seen some dude at the gas station the other day in a little honda car come out right for the road but there was a truck coming up the road so the guy on the highway was luckly paing attention and swerved out of the way, and the guy in the car went 3 feet out into the road to swerve by a car, he pulled around and casualy backed up to get him some gas.
And the other day 2 diffrent people in my senior class got in wreck the very same day, one was in a van and run off the road trying to turn on the radio, they could of got killed but luckly did not get hurt too bad. The other guy was in road construction and was only going about 5mph and looked down to turn on the radio (go figure) and run up under another truck and about totled the car but he did not get hurt either. But to his defence the other car did not have any tail lights.

So try to watch for the other dude on the road because you know what you are going to do but you don't know what that other person has on their mind.

OK Now I'll be serious. Be careful with this thing. If you get them to pay for the deductable, or anything, by recieving their payment that usually puts an end to their liability. Your insurance company will go after them anyway. Just let your insurance company battle with them. Definetely talk to one of those personal injury lawyers, even if you don't have a case you might be able to use him to get info out of him on how to go about this.

What the hell is going on in NC!! Sorry to hear about all this. It is proof that your better off in a bigger vehicle though. Like how Montgomery Gentry talks about not sacrificing his family's safety to save some gas. Everyone is hell bent on producing vehicles that are much better on gas now, and supposedly safety is a big concern. But how is it that all these new vehicles get these great safety ratings, but you're much safer in an older full size Blaser? Maybe it's just 'cause uncle sam is pushing these gas sipping vehicles to please the tree huggers.
