Any one who would intentionally put out a device that could easily kill you is a murderer, plain and simple. A board with nails or a hole is one thing, but a thin wire at neck height has only one purpose, to cut through flesh, and possibly remove the head. When I was 9, my dad had to stop for a snowmobile accident, a guy had cut across a field and went under an electric fence, took his head clean off, still in the helmet.
I can see anger at illegal driving across your property, but death as a punishment?
How would you feel if Dad was taking 5 year old Timmy for a ride, and the wire took off the child's head?? Some of these "nature protectors" scare me, I have seen web sites devoted to deadly booby trap making to "discourage" off road riding, knowing severe injury or death could result. Tree huggers see ATV injuries as a victory to them, reinforcing the "deadly, destructive nature" of the off road hobby. I am not saying we should have uncontrolled access everywhere, we need to balance our intrusions into nature, some areas can easily take a steady traffic of vehicles and not be compromised, while others are damaged beyond belief by only a couple of tracks. Legal, maintained riding areas are vital to keep ATVs off restricted and delicate areas, but a few bad apples continue to give us all a bad name, and encourage the " nature patrol" to act out against us with laws and outright attacks with traps and other methods. I say punish all equally, you ride in a banned area, you get fined or jailed, you put up an illegal fence or a trap, you get arrested for assault or even attempted murder. Leave nature for the hikers and campers, and give us good trails to ride, and everyone could be happy. Sorry for the rant, but some topics really set me off, and this is one of them.

Not a good way to handle that situation.

I'm having a similar problem. A couple of yahoos came tearing through my farm not too long ago. Parked their trucks in my field, unloaded, and had at it. Made a mess out of the creek. I wasn't there at the time, but it's hard not to take that personally.

So how am I going to handle that? Patience and common sense. They came around on a Saturday, so I'm sticking around on weekends. Nailed up a full fence across the trail they came in on - not a single wire. I don't want to injure, I want that nonsense stopped. If they come back... I'm waiting with a high resolution digital camera and 400mm lens. Get photos of their trucks, license plates, them in action, and then find some mean hungry lawyer and sue the pants off of them. Make them pay for my time that they took up. Get a restraining order so if they come back they get jail time just for being there.

Don't injure creeps. That's too easy, and too quick. Toss them to the american legal system - it's the worst possible misery you can inflict on a person, and they'll end up hating the courts and not you.

And if you have kids causing the problem, sue the parents. That will put a stop to the problem real quick, when dad starts losing money out of his pocket.

You can put it behind you till the next time someone infringes on what your husband considers his right to do whatever he desires to obtain personal satisfaction.
How does he react to the neighbor's dog pooping in HIS yard?
What if the neighbor's kids ride their bicycles thru the flowerbed?
Someone takes his parking space?
The next-door neighbor starts a Rock-N-Roll garage band and practices until midnight?
What if someone cuts in front of him in line to the ticket booth?
What does he do when he notices someone filling the trash receptacle with yard clippings and leaves no room for his garbage?
How does he react to someone cutting him off in traffic?
What is the outcome of the family picnic when he notices a mother drop a soiled diaper to the ground next to where he is eating?
Your husband has issues! He has no right to put anyone's life/health in jeopardy because of inconsiderate actions. I'm sure you have not seen the last of the difficulties, disputes and vandalism resulting from hubby's passive aggressive behavior!

Get both sides of the story before assuming that EVERYTHING you read it correct!

Isn't that an assumption in itself?

Interesting first post to the forums, I must say.

So why don't we get to hear the whole story?

You post bits and pieces. Lets here it all.

Put a 5 year old on a quad and measure to the neck.

Even more disgusting that something like that could be done by someone who claims to be protecting children.

Well I'm sure the court system in this country has never let a guilty person go free before.

Posted by: Scootergptx

Well, I would say your anger is understandable.

But the actions are still unforgivable.

So your neighbor knows who bought the quad, yet you didn't get that information? I would think possibly mentioning this to the kids parents might have gotten a little different response. Explaining to them that what the kids were doing is illegal, as well as annoying.

I don't condone the fact they caused property damage as well as were violating the law. But how would you feel if those kids parents did something that put your child in direct harm?

And wouldn't have the security cameras caught the people slashing the tires? That would be helpful to law enforcement on that.

All of this may have been able to avoided if people would simply talk to each other.

Posted by: Scootergptx

Oh, I guess you left some of the story out.

It was wrong of me to assume I had read all sides of that.

Posted by: Scootergptx

Again.

What you have done is no more than you accused the original poster of. One sided story telling.

At least his post was from a verifiable source. (newspaper article)

The "letter" you claim to have is no more valid than the letter I have saying I am the true leader of planet Earth. (I can make copies of it)

The past cannot be changed, but we can only worry what your husband will do in the future. Good luck to you and your child.

Yeah JohnO, you make sure you put out flashing lights, hire a flagman and start a signal fire and rent spotlights so they don't run into that field fence and kill themselves. They just can't cope with the concept of a fence. It is totally alien to them you know. They just can't noodle it through. They seem to just aim themselves at them and wham! It's carnage, death, weeping relatives, followed soon after lawyers. For some odd reasons the cattle I have can seem to grasp the concept fence. I mean they have it down. Even a newborn calf figures it out pretty quick. "Fence. It don't move. It have pointy pokey bits. Don't run at fence at full speed or it hurt bad. Don't go this direction Farmer don't want me go there." They get the concept and they don't need these elaborate safety measures some humans seem to require.

Now just for a point of reference a human has an average brain weight of 1500 grams and a cow has an average brain weigh of just 500 grams. As a percentage of body weight that is 2,1 for the average human and just 0,2 for a cow.

Kyle Clark (Savannah, N.Y.) - A Wayne County man faces a felony charge for laying a booby trap in his neighborhood. Police think one of the people he was trying to catch is a local judge.

All terrain vehicles (ATVs) racing along a dirt path behind Mike Fagner's property in Savannah were noisy and annoying. So he decided to do something about it.

Investigators say he took a thin piece of metal wire and built himself a booby trap.

"It was a booby trap. That's a good way to put it," said District Attorney Rick Healy who is prosecuting Fagner for reckless endangerment. "It's really a bizarre story. I've never seen anything like this before."

Police said Fagner tied one end of the wire to an anchor bolt on a warehouse and tied the other end to a tree. In between lay the path of the fast-moving ATVs.

"And it was at neck level. So this is the kind of thing that could have killed somebody easily," Healy said.

Somebody Special?
Fagner's neighbor told police Fagner said it "wouldn't hurt his feelings" if the booby trap's victim was ATV rider and Town Justice Ed Teneyck.

"Because apparently he ruled against him in a civil case," Healy said.

A grand jury will decide if Fagner was actually targeting the judge.

"That could bring an attempted assault, attempted murder," Healy said.

Fagner reportedly admitted to police he set the trap.

"I don't know what this guy was thinking," Healy said.

Teneyck did not return a request for comment. Because of his involvement, Fagner's case is being heard in another town court.

When I came home from work a couple weeks prior to this, I found two kids on four wheelers making donuts at the end of my driveway. I asked them to please not drive their four wheelers around my house because the loud noise was disturbing my 2 small children when they took their naps and went to bed at night. Their four wheelers have after-market pipes and are extremely loud. A few days later, they started riding by my house again. They were deliberately trying to disturb us by revving the engines in front of my house. They would look towards the house to see who was watching as they passed. One of these four wheelers was bought from my neighbor Francis Steen, who knows the buyer personally.

Francis Steen and I were good friends. We would go to each others home and help each other whenever help was needed. I don't recall the complete conversation, but I told him about the wire. He called Ed TenEyck and reported the wire. I think Ed TenEyck saw this as an opportunity to place charges against me again. (There was as small claims court case against me concerning a baby sitting issue. The judgement was for the sitter.) Per Ed TenEyck's written statement, he said he had ridden on the railroad property also. I have a security camera focusing on the road and my driveway. He has never been seen on our camera by myself or my family. The only riders seen were a before mentioned four wheeler and a dirt bike.

Francis Steen told me the police couldn't do anything about the noise unless the riders were caught in the act. I was told it was illegal to ride on the railroad property and roadways, unless it was to go around an obstacle. Our road has no trails for off road vehicles, so the only reason they would ride down our road would be to get to the railroad property.

The night I placed the wire, I was very upset with the four wheelers. Just earlier that evening, I was on my dead end, normally very quiet street, teaching my daughter how to ride her bicycle. One of the four wheelers zipped passed us, and never even slowed down when they approached my daughter and I. This disregard of peoples safety would anger anyone, especially if their child was involved.

A couple days later, I woke up to find all 12 of my tires slashed. However, the tires on Francis Steen's trailor (parked next to my truck) was never touched. I called 911 and the State Police responded. The policeman asked me what I could have done to anger the person that slashed my tires. I told him about the four wheelers and the wire that I put up to stop the noise. The officer didn't offer any comments. I could have chosen not to say a thing about the wire, or denied putting it up, but I chose to tell the truth. I didn't realize that this piece of wire was illegal. If I had known about the trouble it would cause my family and I, I would not have put it up.

Since the episode, I have been asked why I didn't tie flags on the wire, or use a bright colored rope. It was a low test wire and I placed it low enough to be caught by the machines and then break, causing no harm to anyone but let the driver know he was not wanted here.

Are you kidding me? Your right. The only way he should be called a murderer is if he killed someone with that asinine act, If he didn't kill anyone he should be called a criminal. Being a stupid person does not move you above the law.

Posted by: west350bruin

Who gives a Sh!t about that story...you put up a wire/rope anything where you KNOW there are ATV's..Guess what?! You put up some red flags, markers, notification, so people know its there.
If you wired up a shotgun to shoot the tires and it missed how would that be any different?
That story doesn't sell me, you must have money if it persuaded the DA. Your not fooling me. Sorry, ignorance is no excuse....

Posted by: Mr. Exceptional

That's pretty messed up man. I don't think anything like that has ever happened where I live...that I know of.

But that would take someones head off if they were going fast enough. He is a murderer.

Posted by: DustyJones

The scary thing is how much worse this story could've been.

Does anyone know how the booby trap was discovered before it hurt/ killed anybody?

Posted by: KINGQUAD450

The same thing happened in my grandpal's woods back in the late 70's.
Caught the neighbor's brother in the helemt and threw him clean off the bike.It was a wonder he wasn't hurt.We are pretty sure who put it up but there was no way to prove it was him.

Posted by: KINGQUAD450

He didn't put the wire up someone else put it up on his land. They actually had permission to ride there.

Posted by: KINGQUAD450

I hope you put some kinda flag on the fence you put up. Even a full fence will make a mess out of someone who flies thru it then they will sue the pants off you.

Posted by: str8shooter_usa

Does this sort of thing happen a lot? What that guy did could have had a very different end result. The charges were dropped? I shutter to think he is laughing now becuase he got away with it.

At 58, I am very new to riding; bought my first quad this year. Have been checking a couple of forums for places to ride in upstate New York. The prospects are bleak. Seems like there is a support group these days for just about anything. I am retired now with a lot of time on my hands. I think I am going to look into starting an organized club in my area.

BTW, does anyone have any suggestions about other forums out there focusing ideally in the Rocheser NY/ Monroe County area or just beyond?

yeah well in this case.. this land is posted. NO ONE had permission to ride on this property. so like I stated before. you all need both sides of the story before calling me husband a murderer.
