The point is this.... the environmentalists and the squeaky wheels in this country are winning this war... and people like you and me let them by not getting involved and giving the other side of the fence argument to the local authorities as they are considering what their action should be.

Go ahead and sit in your easy chair while we lose everything... but don't complain when you find out it is too late.

You need to get involved, and get other locals involved as well. Otherwise you will end up like a lot of us who have to travel several hours to enjoy thier sport. Coming to a field near you...

They had better ban all gas powered lawn mowers, chain saws, basket ball courts, and any form of stadium sports at the same time and throw in loud stereos in cars too... they all generate the same amount if not more noise than an ATV with open pipes. It sounds like targeted discrimination to me.

I will not however defend the use of loud pipes... I have said before that the guys that put them on don't give a rat's you know what for your riding rights.. they ruin it for everyone and then either move on, or continue to ride and be a problem while only the law abiding citizens are affected.

Weez, I think everyone agrees with the tone of your answer, but I doubt it will have any weight where the battles are being fought. The "you can't tell me what to do" argument just does not work any longer... I sincerely hope you support the efforts of those that are fighting to keep things open... and oppose those that would take your rights away.

Up your way there is NOHVA or something like that... (I know that is wrong)... but they are out there doing really good work. I'd also send an email to your elected officials that are working closely with the issues to keep your rights alive. The AMA is getting involved as well...

They can also use zoning to keep you from riding on your property. If your property is not zoned for Ag or recreation (say it's commercial or residential) then you are violating zoning laws. This is one way neighbors can force people to stop riding on their own property.

I can't seem to find anything, but I seem to remember there was a law that forbids operating an OHV within a certain distance of a dwelling (much like the laws limiting discharge of a firearm within a particular distance from an occupied dwelling.)

I wish that were true....and it damn well should be true, but there are an alarming number of people are not only banned from riding an ATV on their property, they can't even set foot on their property. Not to long ago I watched a program which showed how a rancher was forbidden to even walk on his property because some environmental extremist group said his land was home to some sort of sand flea. This land had been in his family for many generations and now he can't even enjoy a stroll on the land much less run his ranch (which was how he made a living). Sadly, there are cases like this across the country.

they tried that crap here in mn a couple years ago with wetlands we could farm it but we couldn't drive an atv across it if it was our own land and it didn't last to long cause well who are they to tell us we can or can't drive on our own land even state land they shouldn't be able to tell us we can't drive on it

thanx for the support draggin i don't believe they ever prosecuted anyone for driving across wetlands on their own land actually i am pretty sure of it and they looked back at it and found out a very large percentage of all the private land would have been off limits to atv's so i haven't heard anymore about it the way it sounds i think they threw it out but i am wondering what is a good club to join to keep trails open i know you guys mentioned the blue collar coalition and i was wondering if there are anymore?? preferrably ones that are made up but average people and has nothing to do with the government or the state.

Let them posture all they want, they will never be able to ban you from riding on you own land.

The only thing they can limit are the sound levels. Those that argue that they could just limit the sound level to "zero decibles" or some unattainable limit to ATVs are right on some level. However, that would also elimnate all lawn maintenance quipment, and that would not fly in an actual residential zone. Perhaps a "gated" development with rules and regulations like a condo is the exception. But the moment you move into a place like that you give up your right to do anything.

The moment that you are forbidden from expressing your option to ride an ATV on you own, residential property, without damaging you neighbors property in ANY way possible (and I mean ANY because some lawyer out there is looking at roost that flies onto his cliens lawn as damage) the moment that happens, America as we know it no longer exists.
